Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

Cet entretien réalisé le 30 novembre 1999 à Paris présente l’évolution de la philosophie de Michel Henry, depuis L’essence de la manifestation jusqu’à l’Incarnation. Il s’agit de présenter le projet, la place et la centralité de L’essence de la manifestation dans l’œuvre de M. Henry, puisque c’est dans cet ouvrage qu’il a mis au jour les présuppositions de sa phénoménologie de la vie et de l’intériorité subjective, présuppositions qu’il fera travailler dans tous les ouvrages qui lui succéderont, (...) ceci jusqu’à L’incarnation. Elle s’oppose à une phénoménologie du monde, de l’extériorité et de l’objectivité. Son concept central, celui de chair, pense la matière affective du Soi, c’est-à-dire du corps subjectif. Il est inséparable d’une thèse : à savoir que la corporéité (rapport au corps) est antérieure à l’intentionnalité (rapport au monde). Une phénoménologie du corps subjectif est donc apte à saisir la vie dans son immanence. Perhaps owing to frictions between his Christological worldview and the dominant secularism of contemporary French thought as taken up in the U.S., and persistent worries about a seeming solipsism in his phenomenology, Michel Henry's innovative contributions to aesthetics have received unfortunately little attention in English. The present investigation addresses both issues simultaneously with a new interpretation of his recently-translated 1996 interview, “Art and Phenomenology.” Inspired by this special issue’s theme, “French Thought in Dialogue,” it emphasizes four levels of (...) dialogue in the interview, as follows: (1) the interview as such, with Brohm; (2) its titular dialogue between art and phenomenology; (3) what I term a “trans-religious” dialogue between Christianity’s Jesus and Nietzsche’s Dionysus; and (4) a related dialogue between painting (Henry’s favored genre) and dance that is “Dionysian” (in Nietzsche’s sense). It concludes with new phenomenological accounts of a literal and a figurative dance, namely the social Latin dance called bachata, and an improvised musical dialogue with the mockingbirds of my hometown. In sum, thanks to Henry’s engagement with various forms of dialogue, including with Brohm, the arts, paganism, and dance, one can find room in his transcendental subjectivity of Life for others, dancingly transcending even humanity. This paper takes its departure from Michel Henry’s criticism of a technological view that “extends its reign to the whole planet, sowing desolation and ruin everywhere” ( I am the Truth , 271). It argues that although Henry’s critique of technology is helpful and important, it does not go far enough, inasmuch as it excludes all non-human beings from the Truth of “Life” he advocates against the destructive truths of technology and therefore cannot fully articulate the way (...) in which technology does in fact cause “desolation and ruin” on the entire planet. At the same time I suggest that this strict division between human and non-human life is not essential to Henry’s project, which may well have resources for a more environmentally friendly proposal. The first part of the paper lays out Henry’s critique of technology in some detail, highlighting the ways in which it contains important insights for our contemporary situation. The second part of the paper explores the stark division Henry draws between human generation from the divine life and the creation of everything else, including his rejection of any identification of humans with “protozoa and honey bees,” which would seem to suggest a complete lack of concern for non-human life. The final part of the paper seeks to find a way beyond this dichotomy by showing how non-human life may be included in Henry’s proposal in a way that extends his critique of technology in environmentally conscious ways without losing his phenomenological insights about the human condition. In this paper I focus on a central phenomenological concept in Michel Henry’s work that has often been neglected: generation. Generation becomes an especially important conceptual key to understanding not only the relationship between God and human self but also Henry’s adoption of radical interiority and his critical standpoint with respect to much of the phenomenological tradition in which he is working. Thus in pursuing the theme of generation, I shall introduce many phenomenological-theological terms in Henry’s (...) trilogy on Christianity as well as how he understands the relationship between phenomenology and theology. In the final sections of the paper, I turn to positively defining Henry’s notion of divine generation and examine the theological implications of it in light of his confrontation and rejection of the doctrine of creation in the book of Genesis found in his book, Incarnation: une philosophie de la chair. Humans are not created but are eternally generated, a bold claim that brings Henry to the brink of a kind of interiorized pantheism or Gnostic dualism. Finally, I offer some critical comments specifically about Henry’s doctrine of generation in light of the tension between auto-affection and hetero-affection and thus how one might think after Henry in light of the basic Augustinian theological distinction between self and God and the intentionality of faith opened up by that distinction. Aesthetics is a central topic in the works of Jean-Luc Marion and Michel Henry. While Henry focuses on abstract art (especially Kandinsky), Marion’s writings range over the history of art, including analyses of Courbet, Rothko, and Klee. This article examines their strikingly similar aesthetic theories and shows how they are grounded in a phenomenological claim about the relation between invisible and visible, hence about phenomenality itself. The artist becomes a paradigm for phenomenological receptivity in both thinkers, and (...) art is assigned a quasi-salvific function. En consacrant un ouvrage à la philosophie de Michel Henry, G. Dufour-Kowalska a songé à ce qui sans doute manque (...) le plus à la pensée contemporaine: un enracinement métaphysique de la critique des idéologies et une philosophie de la réalité humaine que l'essor de ces idéologies a fini par oblitérer. Une philosophie de la vie et de la praxis est la "répétition" au sens heidéggerien, mais aussi la découverte éblouie d'une philosophie réaliste, sans doute unique en notre temps, d'une ontologie de l'homme, pour laquelle la Pensée, le Savoir, le Monde des Idées, sont toujours l'apparence et qui voudrait saisir derrière ces expressions relatives et précaires de la vie humaine la force tranquille d'un absolu qui est cette vie elle-même. Henry, el presente trabajo tiene como objetivo ampliar las consideraciones sobre estos al interior de la obra misma de Meister Eckhart. De esta forma, se puede apreciar el movimiento de recepción que el autor francés realizó: la construcción de una imagen de Eckhart que, aunque (...) no se aleja demasiado de los puntos centrales de su teoría, con todo presenta ciertas omisiones que pueden hacer perder el carácter histórico del pensador alemán. Observar aquellos aspectos teóricos que Michel Henry decidió recuperar y los que decidió evitar es útil, a nivel de los diálogos interhistóricos, para observar qué elementos del neoplatonismo cristiano de Eckhart consideró aptos para incorporar a su sistema y cuáles, por el contrario, no encajaban en él. Resumen La filosofía de Michel Henry llevó adelante una propuesta de radicalización de la fenomenología que apela a una puesta en primer plano de la afectividad como expresión de la Vida. Para dar cuenta de la especificidad de este viraje adoptó las categorías opositivas de gnosis griega y gnosis cristiana, la primera asociada con el compromiso de la descripción del mundo en su exterioridad y la segunda vinculada con la experiencia de la carne. Sin embargo, entre las filosofías (...) de la antigüedad griega se halla el caso de la posición de los cirenaicos, que preanuncia numerosos rasgos del tratamiento henryano de la afectividad. Este trabajo estudia esta relación repasando los puntos centrales de la caracterización henryana de gnosis griega para conectarla luego con los presupuestos centrales de la filosofía cirenaica y sus tesis acerca de las afecciones, el tacto interno y el diseño de un lenguaje que refleje la afectividad. Este recorrido permitirá sopesar los alcances de la tesis acerca de la homogeneidad de la gnosis griega y mostrará una deriva importante de antecedentes respecto del pensamiento de la inmanencia.The philosophy of Michel Henry carried out a proposal of radicalization of phenomenology, which appeals to a foregrounding of affectivity as an expression of Life. In order to account for this turn, he proposed the opposing categories of Greek gnosis and Christian gnosis. The first one is associated with the commitment of describing the world in its exteriority and the second one is linked to the experience of the flesh. However, among the philosophies of Greek antiquity, the Cyrenaics raised many issues similar to those of the henryan treatment of affectivity. This work studies this relationship by reviewing the main aspects of the henryan characterization of Greek gnosis and then connects it with the key points of the Cyrenaic philosophy about affection, internal tact and the design of a language that reflects affectivity. This exploration will allow us to evaluate the scope of the thesis about the homogeneity of the Greek gnosis and will show important factors of the ancient thought about immanence. (shrink)

The paper deals with M. Henry’s interpretation of Marxian philosophy in the frame of his phenomenology of life. Its aim is to show the relevance of Henry’s interpretation for the global crisis of capitalism in our times. Henry argues that economic questions in Marx’s Capital, first of all his theory of surplus value, is closely connected with the historical issues in his German ideology. Attention is also paid to Marx’s thesis about the science becoming a direct production (...) force. In the era of automatization, when most of common work is reliably done by the highly developed technological devices, such as artificial intelligence, Marx’s idea of a free development of every individual as a condition of a free development of all is not a utopian one any more. It becomes a normative claim concerning economic and political reality. Thus Marx’s idea of a classless society could be interpreted as a system of global justice, in which the extreme global inequality has been overcome. (shrink)

This is the first part of a two-volume study which may very well represent a turning point of scholarship on Heidegger and a step beyond his position. Paradoxically this work is outstanding both as criticism and as close interpretation of Heidegger. The critical perspectives on Heidegger developed by Regina carry to their natural conclusion some important analyses of the theme of finitude contributed by his colleague, E. Severino, in the mid-sixties. These analyses made clearer the relationship between finitude and the (...) nihilistic tendencies discovered by Heidegger in Western thought. What Heidegger calls metaphysics is the history of the efforts to negate finitude and contingency by ascribing necessity and original worth to one or another ontic property of beings. Heidegger promised on various occasions a destructive history of metaphysics, but his thought in this respect has developed in fragments--on Nietzsche, Descartes, Leibniz, Kant, Plato, Aristotle, and the Presocratics--which require a considerable work of piecing together. Regina's own thesis on finitude, which parallels the important contributions of Michel Henry, makes these pieces fit in what is possibly the best ensemble yet devised with them. A truly brilliant feature of this interpretation is its emphasis on the role attributed to Kant by Heidegger, a role which places Kant outside Western metaphysics and among the pioneers of theoretical investigation of the ties between finitude and transcendence. The direction in which this first part of Regina's work points is that of a possible refocusing on those aspects of Heidegger's work that revalue human dignity. Such refocusing can have so productive an impact on the unification of philosophical work in Europe that the second part of this study should be anxiously awaited.--A. M. (shrink)

Cette étude met en confrontation Michel Henry avec Paul Ricoeur sur la question de la lecture de S. Freud. Il y est donc question de la psyché et de l’affectivité. L’auteur de l’étude rappelle combien le projet de la rationalité contemporaine conjoint des thèses philosophiques sur le statut du sujet et sur celui des schèmes perceptifs de la conscience, au gré d’une relation complexe entre l’étant et le phénomène. L’auteur rappelle les analyses husserliennes relatives à la psyché entendue (...) comme « vie » et ses effets de co-implication. Chez M. Henry, l’inconscient est toutefois compris, soit comme un « inconscient de la représentation », mais cela dans une perspective critique, soit comme cet autre nom de la « vie », spécifiquement dans ses structures d’auto-révélation et d’auto-affectivité. En reprenant la nature du débat entre M. Henry et P. Ricoeur, l’auteur montre que tout l’enjeu réside dans la place que l’on confère aux effets et opérations de la dialectique et de la réflexivité. Le Marx de Michel Henry est un ouvrage paradoxal – comme en témoigne sa conclusion en manière de coup de force, selon laquelle Marx, au motif que sa philosophie contiendrait une « métaphysique de l’individu », est « l’un des premiers penseurs chrétiens de l’Occident » –, et, à ce titre, il ne peut valoir que par l’éclairage inédit qu’il donne aux textes précis qu’il commente. M. Henry procède ainsi en prêtant à Marx une ontologie de la (...) « vie » subjective et monadique, celle-ci étant elle-même déterminée principalement comme « affectivité », tout en cherchant à mettre en lumière les concepts économiques de Marx à partir de cette notion. Tresmontant dans la compréhension henryenne du milieu johannique. Ce n’est toutefois pas tant le parangon de la « philosophie chrétienne » qui retient M. Henry, mais ses recherches autour d’un Christ hébreu, essentiellement utilisées pour fonder une sorte d’archéologie christologique permettant (...) de remonter vers la parole la plus originaire. Par cette médiation inattendue, on voit combien M. Henry recherche à la fois la fondation transcendantale de la parole christique dans son authenticité la plus originaire, mais aussi sa radicale différence par rapport aux mondes grec et juif, celui-ci voyant passer le point de rupture par rapport à la question de l’immanence. In it, the author argues that their respective philosophies can be read as an apologetics of sorts--namely, as arguments for the coherence of thought about God and the viability of religious experience--though each thinker does so in a different fashion and to a different degree. In this paper I consider Ricœur’s negotiation of the boundary or relationship between philosophy and religion in light of the larger debate in contemporary French philosophy. I suggest that contrasting his way of dealing with the intersection of the two discourses to that of two other French thinkers (Jean-Luc Marion and Michel Henry) illuminates his stance more fully. I begin with a brief outline of Ricœur’s claims about the distinction or relation between the discourses, then reflect on those (...) of Marion and Henry, who although they do not relate them in the same way still together form a significant contrast to Ricœur’s perspective, and conclude with a fuller consideration of Ricœur’s methodology in light of this comparison. I suggest that it is in particular his hermeneutic commitments that lead him both to more rigorous distinctions between discourses and ironically to greater mediation. (shrink)

Si Nietzsche est tout particulièrement l’auteur qui sert de point d’appui à M. Henry pour remettre en question l’approche grecque de la phénoménalité, c’est parce que le philosophe allemand incarne précisément le retour à la Grèce tragique de l’époque archaïque, si bien que l’exception que ce dernier (...) représente dans la philosophie occidentale tient au fait qu’il met en œuvre des présupposés phénoménologiques différents de ceux de la Grèce idéaliste. La référence positive à Nietzsche chez M. Henry est toutefois suivie d’une période dans laquelle M. Henry prendra ses distances avec le philosophe allemand. É neste processo (...) que Michel Henry se torna, para Jean-Luc Marion, determinante: a declinaçāo do ego à fenomenologia do sentir abre-nos a um novo futuro fenomenològico. Nele a ética revela-se como a verdade da forma de vida daquele que vive num corpo dotado de sentidos. Michel Henry and Jean-Luc Manon's phenomenology has re-defined philosophy and has opened us to an universe of increasingly interest concepts of health sciences. The declination of the ego in a body endowed by senses has reversed the logical order of Descartes's philosophical principles - science, foundation of science, metaphysic, ethics/ethics, into metaphysic, foundation of science and sciences - in such a way that Jean-Luc Marion ended to replace the Metaphysics Meditations by the Erotic Meditations. It is why Michel Henry was so determinant to Jean-Luc Marion: the declination of the ego to the phenomenology of feelings is leading us to a new phenomenological future. In it, ethics reveals to be a real and true way of life of those who live in a body endowed by senses. (shrink)

This paper highlights several problems in the contemporary phenomenological analysis of religious experience in Continental philosophy of religion, especially in its French iteration, as manifested in such thinkers as Jean-Luc Marion, Michel Henry, Jean-Yves Lacoste, Jean-Louis Chrétien, Emmanuel Falque, and others. After laying out the main issues, the paper proposes a fuller investigation of religious practices, such as liturgy or ritual, as a fruitful way to address some of the identified limitations. The final section of the paper assesses (...) what questions remain and how one might draw on existing resources in these thinkers to push a phenomenological analysis of religious practices further in ways that broaden phenomenology of religion beyond its current somewhat narrow strictures and commitments. La question du phénomène précède de beaucoup la phénoménologie, elle s'ouvre avec la philosophie et l'accompagne tout au long de son histoire. Mais ce préalable incontournable - car être veut dire apparaître - est surdéterminé par une présupposition irréfléchie. De la Grèce à Heidegger, dans les problématiques classiques de la conscience et de la représentation, dans leurs critiques, dans la phénoménologie de l'intentionnalité et dans ses prolongements, "phénomène" désigne ce qui se montre à l'intérieur d'un horizon de visihilisation, l'Ek-stase d'un (...) Dehors. La mise en cause de ce monisme ontologique établit que l'Ekstase ne subsiste que sur le Fond de son anti-essence : immanence si radicale qu'elle ne se tient jamais à distance, incapable de se voix, âme sans Idée, vie dépourvue d'archétype mais liée à soi invinciblement, s'éprouvant dans le subir, le souffrir et le jouir de son propre pathos. A part of the “return to religion” now evident in European philosophy, this book represents the culmination of the career of a leading phenomenological thinker whose earlier works trace a trajectory from Marx through a genealogy of psychoanalysis that interprets Descartes’s “I think, I am” as “I feel myself thinking, I am.” In this book, Henry does not ask whether Christianity is “true” or “false.” Rather, what is in question here is what Christianity considers as truth, what kind of (...) truth it offers to people, what it endeavors to communicate to them, not as a theoretical and indifferent truth, but as the essential truth that by some mysterious affinity is suitable for them, to the point that it alone is capable of ensuring them salvation. In the process, Henry inevitably argues against the concept of truth that dominates modern thought and determines, in its multiple implications, the world in which we live. Henry argues that Christ undoes “the truth of the world,” that He is an access to the infinity of self-love, to a radical subjectivity that admits no outside, to the immanence of affective life found beyond the despair fatally attached to all objectifying thought. The Kingdom of God accomplishes itself in the here and now through the love of Christ in what Henry calls “the auto-affection of Life.” In this condition, he argues, all problems of lack, ambivalence, and false projection are resolved. Le christianisme bouleverse notre conception de l'homme parce qu'il refuse la manière dont celui-ci se comprend depuis toujours à partir du monde, de sa vérité et de ses lois. Selon le christianisme, l'homme ne procède pas du monde mais de Dieu: il est son " Fils ". Or Dieu est Vie, Vie qui ne se montre en aucun monde, qui s'éprouve elle-même dans son intériorité invisible. L'autorévélation de la Vie est l'essence de Dieu. Cette épreuve de soi de la Vie (...) fonde tout Soi et tout Moi, toute individualité et tout individu - tout " homme " concevable. L'opposition de la Vérité de la Vie et de la vérité du monde permet, d'autre part, de savoir que Jésus est le Christ. Dans le monde, Jésus a l'apparence d'un homme. C'est seulement en se plaçant à l'intérieur du mouvement de la Vie qu'on peut saisir comment celle-ci génère en elle un Premier Vivant et, en lui, tout vivant possible. Ce livre ne demande donc pas si le christianisme est vrai ou faux. Il met à nu le genre de Vérité que le christianisme professe et propose aux hommes. If we are to understand Marx's thought, argues French philosopher Michel Henry, we must cast aside Marxism. In his original and richly detailed study of Marx's philosophy, Henry emphasizes the importance of approaching Marx's writings directly, rather than through the intermediary of subsequent interpretations, which often have been politically motivated. Plus qu’aucune autre dans la tradition phénoménologique, la pensée de Michel Henry semble prêter le flanc à l’objection de solipsisme : non seulement en raison de son traitement en apparence tardif du problème de l’expérience d’autrui, mais aussi en ceci que, positivement cette fois, L’essence de la manifestation fait explicitement de la « solitude » l’un des traits fondamentaux de l’être de l’ego. À rebours d’une telle interprétation, et prenant appui sur un ensemble de notes de jeunesse parfois (...) inédites, cette étude se propose au contraire de montrer qu’une telle « solitude », parce qu’elle permet de conférer à l’idée même de « subjectivité » une signification tout à fait nouvelle et originale, constitue aux yeux de M.
